US court rules on damages for Genus technology infringements

Genus on Wednesday said a US court had ruled on damages over infringement of two bull semen sexing patents sold by ABS Global under the Intelligen brand.

A District Court jury in Wisconsin said ABS should pay a royalty of $2.60 per straw sold for the infringement of the patents, known as 476 and 309, for 3.3m straws sold up to 30 June 2019.
The damages will be retrospective only as ABS has now modified the technology to avoid continued infringement.
On Tuesday, the jury held that the IntelliGen technology infringed three other patents, which confirmed ABS' existing obligation to pay a royalty of $1.25 for each straw of sexed semen produced in the US, the company said.
ABS is considering its options for appeal, Genus said.
